Understanding the OHAO Appeal Process

The OHAO appeals process is complex but with the right preparation and support it is possible to restore your driving privileges.

Eligibility Assessment

Two OHAO convictions within 7 years or three within 10 years results in revocation. After a minimum of one year — or five years for repeat cases — you may request a hearing with OHAO.

Substance Abuse Evaluation

The Michigan Secretary of State requires a substance abuse evaluation from a qualified expert. Getting this right the first time is critical to your case.

Build Your Evidence Package

A successful appeal requires clear and convincing evidence including letters of support sobriety documentation and a completed substance abuse evaluation.

OHAO Hearing Preparation

Every detail matters. Hearing officers begin from the presumption that repeat DUI behavior is an ongoing risk so your case must be thorough and airtight.

The Hearing

At the hearing you or your attorney presents arguments and supporting documentation. If approved you will receive a notice to get your license at a Secretary of State branch office.

Circuit Court Appeal If Needed

Recreational marijuana use disqualifies sobriety claims even though it is legal in Michigan.
